When you are deciding if you should take an Uber to a concert across town, you want to know if you and a couple of friends can use the same Uber. Can you and three friends take an Uber to get to a concert, show, or game? Do you have to plan on piling into a car and dealing with the hassle of parking?
Can You Take three or More Passengers in an Uber? Yes, but you must select the correct service to do so. In some cases like Uber Pool, you are limited to only two people in total. With other services such as Uber XL, you can take up to 7 people if there are enough seats in the S.U.V. With Uber WAV, you are allowed to take as many people as there are seats.
If you think this sounds complicated, you are not alone. However, selecting the wrong type of Uber ride might lead to an unpleasant surprise. For instance, you might decide to pick Uber pool because it’s cheaper, and later realize you’re going to be late because the driver kept picking up additional passengers whose stops come before yours.
Let’s go over the options so you can decide if one of them will work for you.
How Many Passengers Can You Take in An Uber?
You can carry as many passengers as seatbelts that you have in any Uber ride. However, there are different types of Uber rides and each one has differences in their seating capabilities. The most popular option is Uber X.
Uber X is generally considered a 1-4 passenger ride; however, most Uber X drivers use small economical cars to transport passengers, making a four-person ride uncomfortable.
Another option is Uber Pool, which is slightly cheaper than an Uber X ride, you are limited to yourself and one passenger, or two seats maximum. With the Uber pool, you do pay for the extra seat. If you do not disclose your passenger, then the driver is obligated to refuse the ride to the additional person, as they may be routed to pick up another passenger who paid for that seat.
When Using Uber Black, or Uber Select, the requirements are the same as for Uber X. You can take up to three people with you (a total of 4 passengers). With these rides, however, the drivers typically will have full-size luxury vehicles capable of carrying five (four passengers + the Uber driver) people comfortably.
When using a specialty service such as Uber Wav or Uber Lux, you are limited to the number of seats in the vehicle. Both programs are relatively new to the Uber Marketplace and may not be available in all areas. The minimum requirement for Uber Lux vehicles is four passengers.
Uber Pool is a carpool service. You can arrange for up to 2 seats only with an Uber pool. Typically on an Uber Pool ride, a driver may have several stops in between your stop and the next pick up. Uber pool is not meant for people in a hurry.
Uber Pool is for the person that is not on a tight time crunch and doesn’t mind having other people in the car. At times you may experience going out of your way, or even picking up passengers that do not match your destination.
Uber is continuously trying to improve their formula for matching drivers to passengers on the Uber Pool Rides. It is possible if the driver gets back-to-back rides that your destination could take a while to reach. Drivers must follow the route assigned by Uber in Uber Pool.
Uber Pool is excellent if you are not in a hurry, going to the mall on your day off, or traveling to see a friend. It is cheaper than Uber X, and you will get to your destination eventually

For a vehicle to meet Uber Black standards, it must seat a minimum of four passengers comfortably in a luxury style vehicle. This is the most expensive option when selecting an Uber ride. An Uber Black driver has to meet more stringent requirements compared to Uber X, XL, and Select.
Requirements are as follows:
- Commercially Licensed
- Commercial Vehicle Registration
- Commercial Vehicle Insurance
- Airport Permits
- Must use one of the following vehicles:
- Mercedes-Benz: E Class (Sedan) or GL-Class (SUV)
- Lexus: GS (Sedan) or LX (SUV)
- Infiniti: Q70 (Sedan) or QX56, QX80 (SUV)
- GMC: Yukon XL (SUV)
- Cadillac: XTS (Sedan) or Escalade ESV (SUV)
- Chevrolet: Suburban (SUV)
- Lincoln: Navigator L (SUV)
- Jaguar: XF (Sedan)
- Audi: A6 or A7 (Sedan)
- BMW: 5 Series (Sedan)
Uber Black is also not offered in every city–only select cities that Uber chooses to release the service. You may be able to rent one of these lovely cars in your area, but it may not be cost-effective.
HyreCar is a service that offers rental cars for less, and they may be able to provide more details on the requirements for Uber Black here. You may be able to find a qualifying vehicle from a rental car company, but chances are you won’t make much money after paying all of the fees.
Uber Xl has a different set of rules as well, such as the vehicle seating capacity is greater than the standard requirements for Uber X. Although the S.U.V. can be any color, this is the ride that you want to reserve if you have more than five people.
This Rideshare program is going to be a larger S.U.V. with higher premiums due when reserving.
Some of the requirements for this category vehicle are:
- A 4-door vehicle with independently opening passenger doors
- Have seven factory-installed seats and seat belts
- Working windows and air conditioning
- No vans, box trucks, or similar vehicles
- No taxi cabs, government cars, or other marked vehicles
- No salvaged or rebuilt vehicles
- No aftermarket seating modifications, such as installed seats, seat belts, or BedRyder systems
- Vehicle must be registered and insured in the state in which the Uber service is provided
Another helpful tidbit is that Uber XL drivers must go above and beyond to keep a 5-star rating, or they lose the XL status and are only eligible for Uber X. You are going to get top of the line service with an Uber XL.
First, the driver must do Uber X or XL before being accepted into Uber Select. The Driver must also use an approved vehicle similar to the ones listed under Uber Black. Uber Select hower, does not allow the driver to use a rental car.
Uber Select can carry anywhere from 4-7 passengers depending on the Driver. If you need a seven-passenger vehicle, it is best to use Uber XL. Uber Select vehicles must also have leather interior, and no commercial vehicles are allowed.
The list for Uber Select expands to all luxury brand vehicles as long as the cars have leather and can seat at least four people plus the driver. Some of the more popular models are the Toyota Avalon and the Tesla Model S.
Uber Select is suitable for a date night, or maybe even a special event that you are going to. It is slightly on the pricer side of Uber rides, but it is also a comfortable ride. If you have three other passengers with you, I would also recommend Uber Select. The vehicles tend to be larger.
Uber Wav (Wheelchair Accessible Vehicle)
Uber Wav is being tested in specific markets right now. Uber Wav provides rides to customers that need to get somewhere but have a medical restraint such as needing to commute on a Rascal®. The Drivers for this program must go through a third party certification to be medically prepared to help you.
You can take as many passengers as there are seatbelts and available seats in this program. Every vehicle will be different, but it is safe to say that at least two people could accompany you on your journey.
If you have a service animal, you can also bring them with you; it is against the law for anyone to refuse service to a person that requires a service animal, including a ride share service. Uber also has its policies that dictate how drivers should handle passengers with service animals.
It is easy to select, open the app and enter your destination, and choose WAV at the bottom of your screen. This option lets Uber know that you need a Wheelchair Accessible vehicle. If you have a foldable wheelchair, you may not need to order an Uber WAV; you may be just fine with an Uber X.
Does a Baby Count as a Passenger in Uber?
Yes, a baby does counts as a passenger in an Uber, just like in your vehicle. The Uber driver is bound by the traffic laws of each state, as well as the federal requirements. Each baby must be placed in a federally approved child restraint system.
A driver can refuse the ride if the child is not properly restrained, and in most cases, it is required that the driver make sure you have placed them into a child restraint system. Driving a child without a child restraint system in place is a monetary fine plus points on your license (see specific penalties by State here).
Just to put this into perspective: about 12,000 children die every year from unintentional vehicle injuries. It only takes a minute (find out more at CDC.gov).
If you are traveling and don’t want to lug your car seat around all day, you can order an Uber X with a forward-facing child seat and two booster seats in the Uber App. For this in most states, your child must be at least one year old or 22 pounds. In some states such as California, your child must be at least two-years-old to use a forward-facing car seat.
Car Seat Laws
Every state has its own car seat laws. Most states do say that you must carry any child under eight years old in a federally approved car seat. Each state also defines who is responsible for making sure that the child is appropriately restrained.
Most states, the Laws are :
|Provide a Federally approved child restraint system that is appropriate for the state, and well as any other state you are traveling to.||Provide a Federally approved child restraint system.|
|Allow the driver to provide a federally-approved restraint system.||Allow Parents to provide a federally approved child restraint system.|
|Install or confirm the proper installation of the seat in the vehicle.||Install or confirm the appropriate installation of the seat, in the vehicle.|
|Secure or confirm that the Child is secured in the restraint system.||Secure or confirm that the child is secured in the restraint system.|
Each state has their age requirements ranging from under four years old to under nine years old. You can read more about your own states’ laws here.
It is unclear who is legally responsible for making sure the child is restrained correctly; the driver of the vehicle is usually determined to be the guilty party in the event of an accident. As a driver, I would want to make sure the child is restrained correctly before starting the ride.
Who is Responsible for Making Sure the Passenger is Restrained?
In almost every state, the operator of the vehicle is responsible for making sure that everyone is appropriately restrained before driving the car. In some states, the driver can be held legally responsible if a passenger was not properly restrained.
The laws generally state that the driver who is carrying passengers should act reasonably in caring for his/her passengers, which means that ultimately the driver of the vehicle is responsible for their passengers. The passenger can bring a lawsuit against the driver in the event of an accident for knowingly driving them without ensuring they were correctly restrained.
The passenger can bring several lawsuits to the responsible parties in the event of a crash. Since the driver is responsible for the care of their passenger’s best interest, this means that your passenger can sue you, even if someone else hits your car!
Not only is having more passengers than seats available against Uber’s Terms of Service, but you are also putting yourself at risk for multiple lawsuits. Not only would you have at least one unrestrained passenger, but you have a loose 150 pound plus object that is at the will of Newton’s laws of Physics freely able to bounce around in your back seat in the event of a collision. It is almost guaranteed there would be severe injuries. In addition, there could be legal ramifications from both Uber and the Police.
Not a lot of information is available quite yet on Uber Lux. It is available in select markets such as Los Angeles and San Francisco. Uber Lux is your top of the Line service that includes a professional driver and the top of the line luxury vehicles.
Uber Lux has higher premiums–almost double of Uber Black. You are riding around in style using this service; it is the red carpet of Uber rides. Uber Select is more of a trip to the store or across town, and Uber Lux is what you would use to go to the Music Awards.
Selecting the Correct Uber
Choosing the correct uber ride would depend on the problem that you are trying to solve. Do you need a ride to work? Uber X would be perfect. If you need to have your grandparents picked up from the airport and delivered to your home, then you would want to go with an Uber Select or perhaps an Uber XL.
Remember to consider anyone that needs a seatbelt, and even animals are considered a passenger in some states. It is illegal to refuse service to a person with a service animal, because of the service animal. Service animals are allowed in all vehicle programs.

No Matter which option you choose, you want to make sure that you are enjoying the experience. You are not paying so much for the ride with the more expensive options–you are paying for the experience. Although Uber Lux is twice the cost of Uber Black, you are getting your money’s worth if the experience meets your expectations. After all, a traditional Limousine service might cost several hundred dollars an hour with an additional fee for any “extras” you decide to consume.
With Uber, you can hire a professional driver in some areas for a fraction of the cost.
